PPP项目争端谈判的关键影响因素

摘要：随着近年来我国PPP模式的不断推广与发展，PPP项目争端谈判问题目益凸显，造成项目成本增加，履约效率降低等不利影响。为了规避不必要的争端谈判以及提高谈判效率，基于不完全契约理论来探索PPP 项目争端谈判的关键影响因素。首先，通过国内外文献研究与案例分析，总结识别出25个PPP项目争端谈判影响因素；其次，运用问卷调查法和因子分析法收集与处理数据，最终提取出5个PPP项目争端谈判的关键影响因素，并将其归纳命名为风险分担与利益共享、参与方履约能力与合作关系、制度与监督体系、项目过程管控
和项目变更；最后，分析关键影响因素并提出相应对策建议，为促进PPP模式在我国健康发展提供参考。关键词：PPP；争端谈判；问卷调查；因子分析

Abstract: In recent years, with the promotion and development of PPP models in China, dispute negotiation has become increasingly prominent in PPP projects, resulting in increased project costs and reduced efficiency of contract administration. In order to avoid unnecessary disputeandimprove the efficiency of dispute negotiation, this paper investigated the critical factors influencing the dispute negotiation in PPP projects based on incomplete contract theory. First, through literature review and case studies, the paper identified 25 factors that would influence PPP dispute negotiation. Next, by adopting questionnaire survey method and factor analysis, and following collecting and analyzing data, the research extracted five critical factors, which are named sharing of risk and benefit, participation and cooperation, system and supervision, process control in project and project change. Finally, after the analysis of the five critical factors gained, the paper proposedbased on the research resultsto provide references for futurePPP development in China.
