基于PPP模式的地下综合管廊项目合同柔性问题

摘要：以PPP模式推进地下综合管廊建设成为现阶段城市市政基础设施建设的热点，但在我国关于地下空间权属的相关顶层设计尚不完善，综合管廊项目收费机制缺失带来的不确定性成为了推进PPP模式在地下综合管廊建设中应用的重大障碍。本文将合同柔性的概念引人地下综合管廊PPP项目的实施过程，介绍了合同柔性在建设工程领域的研究成果，阐述了综合管廊PPP项目采购阶段实现合同柔性的合作环境、运作方式、合同框架等基础条件，对地下综合管廊PPP项目的合同柔性重点政府补贴机制提出了激励性、保障性和动态可调性
化的调节能力。

Contract FlexibilityProblem in UtilityTunnel Based on the PPP Model

Abstract: Using PPP model in the construction of utility tunnel is becoming a hot spot of current city municipal infrastructure construction, but the related top-level design about underground space ownership in our country is not yet perfect and the uncertainty caused by the lack of charge mechanism is still the great obstacle for promoting the application of PPP model in construction of utility tunnel. This paper introduces the concept of contract flexibility in the process of the construction of utility tunnel and the research results of contract flexibility in the field of construction project, then expounds the basic conditions of cooperation environment, operation model and contract framework in the purchase phase to realize contract flexibility. We put forward the design principles of incentive, affordable and dynamically adjustable in the mechanism of government subsidy. Finally, we advise to design of the construction and operation of separation mechanism of government subsidyto improve the adjustment ability of the project along with the market changes.

地下综合管廊是一种可以容纳给排水、电力、通信、燃气等多种管线于一体的市政基础设施，是城市地下管道的综合走廊。与发达国家和地区相比，我国地下综合管廊的建设才刚刚起步，进入 2014年之后，相关政策密集出台并不断加码.同时随着国内政府和社会资本合作（PPP）模式在各领域的推广,PPP模式与地下综合管廊的结合将

成为推进我国地下空间开发的新着力点。将PPP 模式应用于综合管廊的建设需要考虑两者各自的特点和适应性，更需要从合同管理的角度来保障项目的顺利运行。本文试着从合同柔性的视角，解决综合管廊PPP项目收费机制缺失在特许经营期内带来的不确定性问题，推进PPP模式在综合管廊建设中的应用。
