现阶段我国小产权房的解决途径

摘要:随着我国改革开放和市场经济的发展,工业化和城镇化路程的加快,以及经济快速增长带动的城市化聚集效应,大量农村人口向城市转移;再加上城市中低收入居民改善居住的需求,导致城市的房地产市场需求旺盛,住宅供应量严重不足,供需矛盾日益突出。在巨大利益的驱使下,各地出现很多利用我国城乡二元土地所有制存在的政策漏洞所建设的房价相对低康的小产权房,引起了房地产市场的混乱,论文通过分析小产权房出现的主要根源,
从政府管理角度提出了解决小产权房问题的途径。关键词:小产权房;土地制度,解决途径

Abstract :Since china's reform and opening-up policy, along with the development of the market economy, the in dustrialization and urbanization have been accelerated. As a result, the aggregation effect of urbanization and transfer of rural population to urban have been driven by the rapid economic growth, In addition, the needs of the improvement of their living conditions of low-income residents in cities resulted in strong demand for the citys real estate market and a serious shortage of housing supply, which means that the contradiction between supply and demand became increas. ingly prominent. Driven by huge profits, the investment of the houses with limited property at low cost, which were built by use of the existing loopholes of urban and rural land ownership policy, caused the real estate market confusion This paper analyzes the main causes of the appearance of the houses with limited property and proposes ways to solve the problem from the perspective of government.

所谓小产权房是指在农村集体土地上建设的房屋,未缴纳土地出让金等费用,其产权证不是由国家房管部门颁发,而是由乡政府或村政府颁发。“小产权房”不是法律概念,是人们在社会实践中形成的一种约定俗成的称谓。该类房没有国家发放的土地便用证和预售许可证,购房合同在国土房管局不会给予备案。所谓产权证亦不是真正合法有效的产权证。向本集体经济组织外成员销售的房屋,购买者只有村集体发放的房屋所有证明,没有国家的土地使用权证和房屋所有权证,又叫做“乡产权房”。
小产权房主要有三种特征:一是在集体所有土地上建设的、未缴纳土地出让金等费用;二是面向本集体组织以外的成员出售的;三是其产权是由乡政府或村委会颁发而不是由国家房管部门颁发的。这种房屋具
