轻轨交通审批与建管的法规标准研究

摘要：对比地铁，指出轻轨和有轨电车在立项审批、规划设计、运营安全方面存在法规缺失和标准薄弱等问题。由于轻轨和有轨电车概念不清晰，在立项审批上，轻轨和有轨电车的审批权限不够明确，各地有轨电车立项审批的要求、要件不一致；在规划设计方面，部分新型轨道交通以及以C型车为基础的轻轨系统规划设计标准尚有缺失；在运营安全方面，《中华人民共和国道路交通安全法》中尚无专门针对有轨电车和轻轨方面的条例。建议在轻轨概念分级分类的基础上，划分审批权限和申报程序；补充有轨电车线网规划编制标准和新型轨道交通的设计标准，并在《中华人民共和国道路交通安全法》中补充轻轨和有轨电车运营安全等方面的立法以及相关管理办法。

Abstract: This paper focuses on the limitations of laws, regulations, and standards for LRT project approval, design, and operation by making a comparison it with metro. First of all, the definitions of LRT and tramways are confusing, which leads to a vague project approval procedure and inconsistent approval requirements for LRT and tramways. Second, the design and planning standards for rail and LRT based on the new type C vehicle are not yet available, In terms of operational safety, there are no specific regulations for LRT and tramways in the Road Traffic Safety Law of the People's Republic of China Therefore, this paper suggests the following: divide the project approval authority and procedure according to the level of LRT; develop design standards for LRT and tram network planning; include the management of LRT and tram operational safety in the Road Traffic Safety Law of the People's Republic of China
